Aos srs. Associados no Umuarama, permitimo-nos esclarecer, que a finalidade do abaixo assinado entregue em 30/04/2014 ao Presidente do Instituto Presbiteriano Mackenzie,


constitui uma tentativa em se reestabelecer um dialogo harmonioso entre a Associação, seu Conselho e o Instituto, em nivel de  Diretorias.

A desastrosa ocorrência em Fevereiro/Março deste ano (derrubada desnecessária de árvores) à discrição de um único funcionário do Instituto, foi algo deveras chocante para todos os proprietários no Umuarama.

Qualquer pessoa consciente, de bom senso, se dará conta de que foi cometido um estrago !

Preocupamos-nos seriamente com o futuro do Umuarama. É sabido que numa entidade do porte do Instituto, Presidentes e Diretores no comando, são de tempo em tempo aposentados. Nem sempre seus sucessores têm uma visão detalhada dos assuntos, como no caso do Umuarama, distante 180 km das salas das Diretorias.

O Umuarama tem uma história da qual poucos têm conhecimento, que passamos a relatar abaixo para consciência de todos os proprietários.

Durante os 38 anos de cuidados dispensados ao Umuarama pelo escritório do Sr. Hering, em Fev/2014, foi a primeira vez em que os associados se depararam com um problema seriamente preocupante, de interesse comum dos condôminos proprietários no Umuarama.

Apelamos, pois para a compreensão da Presidência e Diretoria do Instituto P. Mackenzie, no sentido de colaborarem em se reinstituir um meio de comunicação harmonioso ao nível de diretorias entre o Instituto e a Associação dos Proprietários no Umuarama. A associação, durante as últimas 4 décadas contribuiu com significativas melhorias, todas visando a preservação de uma área extremamente privilegiada em Campos do Jordão.

Relatos encontrados nos arquivos do Sr. Hering:

    A Associação Umuarama de Campos do Jordão foi fundada na década de 1920 por iniciativa de Erasmo Braga, que reuniu 6 entidades evangélicas para aquisição de uma área em Campos do Jordão (240 hectares) – local onde pudessem realizar retiros espirituais e repousar. Contrataram o construtor Floriano Rodrigues Pinheiro para a edificação, na época chamada Pensão Umuarama, posteriormente Hotel Umuarama. Na década de 1940 tinha como gerente o hoteleiro suíço, Daniel Perret que ali vivia com sua família. Sr.Daniel era muito benquisto pelos funcionários, hospedes e pelos arrendatários (atuais proprietários). Desligou-se do Hotel em 1965, mas residiu no Umuarama até 1985. Aqueles tempos foram marcantes para todos jovens que frequentaram o Umuarama, onde se hospedavam durante as férias escolares, particularmente alunos do então colégio Mackenzie. Realizavam-se excursões frequentes como: ao Pico do Itapeva, à Pedra do Baú, etc., enfim atividades inesquecíveis ali promovidas dia a dia. Pastores cuidavam dos retiros espirituais, pregavam, inclusive à beira do lago. Na época, barcos (catraias) e cavalos eram alugados pelo Hotel aos seus hospedes.

Antes daquele período, a Associação com o fito de obter uma receita adicional e atrair interessados em construir suas casas de veraneio nos arredores, elaborou uma planta de lotes de terrenos localizados no lado Norte da ampla área. Tais lotes se tornaram objeto de arrendamento “por prazo indeterminado”, contra pagamento de contribuições anuais, isto com a finalidade de prover arrecadação suficiente para a manutenção geral do Umuarama, como: conservação de ruas internas e suprimento de água, que na época era captada na antiga nascente, localizada nas proximidades da atual Vila Caajara (não a atual captação que ora supre o reservatório geral Mackenzie).

Durante a década de 1960, por iniciativa e custeio exclusivo de 2  arrendatários, Siegmund Gansl (“Clair Soleil”) e Marc de Cepibus (“Sans Souci“), unidos instalaram a primeira linha de suprimento d’água, captada nas nascentes ora em uso, que suprem o Reservatório geral Mackenzie.

Em 1965, quando o gerente do Hotel Sr. Daniel Perret considerou impraticável a ideia sugerida, de o Hotel fabricar geleias para comercialização, a Associação Umuarama o aposentou. Foi contratado como gerente, Sr. Paulo Sampaio, ex-funcionário da Superbom (Organização Adventista).

Assim, o Hotel Umuarama começou a produzir geleias. Poucos anos depois se deram conta de que tal negócio não prosperaria. O Hotel foi fechado definitivamente e o prédio foi alugado para o “Acampamento dos Pumas”, que posteriormente o desocupou.

Em 1975 os prédios da Associação Umuarama ficaram completamente abandonados. Nem a porteira que existira à entrada do Umuarama restou.

Em 1976 o Umuarama estava na iminência de cair no domínio publico, pois sequer placa “particular” fora ali colocada. Muitas casas foram assaltadas o que causou muito desgosto aos arrendatarios.           Certo dia Sr. Hering passeando com sua filha na atual rua da Colonia, encontrou um veículo parado, em que um casal se portava inconvenientemente. Alertou-os de que a área era (rua) particular e sugeriu-lhes que se retirassem.

No dia seguinte telefonou para Dr. Lindolfo K. Anders, (então Presidente da Associação Umuarama de Campos do Jordão), indagando, se apoiaria a ideia de se reunirem os arrendatários no sentido  de se cotizarem p/ edificação de uma portaria no mesmo local onde existira no passado uma porteira e “mata-burro”. Isto caracterizaria a "propriedade particular" e impediria a entrada de estranhos. Felizmente Dr. Lindolfo, homem sábio de visão, não hesitou.
Dr.Anders respondeu: “Se o sr. Hering reúnir os arrendatários, eu reúno as igrejas”;
Sr.Hering contratou um arquiteto que esboçou o que atualmente (2014) ali existe, a modesta portaria – (o estritamente necessário para abrigar um vigilante);
Dr.Lindolfo enviou para o escritório do Sr. Hering um projeto alternativo - edificação de maior porte, que não caberia no espaço ali disponível - local escolhido como ideal.
 De mutuo acordo optaram pelo projeto (Arq. Oscar Ricardo Conrad), cuja execução custaria ¼ do preço da edificação maior sugerida pela Associação.

O escritório do Sr. Hering, solicitou à Construtora Floriano R. Pinheiro, orçamento para a construção da portaria. Em seguida Sr. Hering enviou correspondência, contendo uma exposição de motivos a todos os arrendatários, comunicando-lhes o valor da contribuição correspondente, para a realização desta melhoria em benefício da Preservação do Umuarama.
 Para sua surpresa após um mês seu escritório o informou que a conta aberta, para esta finalidade, já dispunha o saldo suficiente para o custeio da obra. Em seguida, Jayme Rocha Pinheiro, filho de Floriano Rodrigues Pinheiro, iniciou a obra.

Ao regressar de viagem Sr.Hering recebeu o pequeno abrigo (Portaria) acabado a pleno contento. Constatou que a arrecadação havia excedido à sua expectativa otimista.
Contratou vigilantes (Porteiros) diurnos e funcionários para manutenção geral das ruas e suprimento de água. Os mesmos foram registrados na forma da Lei. Fe-lo em seu nome pessoal, pois na época não existia a Associação dos Proprietários no Umuarama, constituída somente em 2007 (30 anos mais tarde).

Antes de contratar porteiros noturnos, à noite uma corrente era trancada com cadeado e cada proprietário de casa fora provido de chaves. Após algum tempo tornou-se frequente a quebra do cadeado que foi substituído sucessivamente. Era quebrado pelos próprios condôminos que haviam “esquecido” as chaves em casa.

 No ano seguinte Sr. Hering contratou um porteiro noturno. Dos 30 contribuintes na época (“condôminos de fato”) somente um questionou tal iniciativa, sob alegação de que já mantinha “caseiro” para guarda de sua casa. Mas em reunião junto ao Mackenzie, com o condômino e representantes do escritório do Sr. Hering, após esclarecimentos sobre a iniciativa e analisadas as contas apresentadas, prontamente aprovadas, o mesmo incontinenti quitou seu débito .
   
Naquela época a responsabilidade trabalhista era exclusiva do Sr. Hering, que havia por assim dizer criado um “condomínio de fato”. Não existira outra alternativa para manter funcionários trabalhando na conservação interna do Umuarama.

Breve retrospectiva das responsabilidades assumidas pelo Escritório (Sr. Hering) atual gestor da Associação dos Proprietários no Umuarama:

Revendo arquivos do Escritório, constatamos, que além da manutenção de rotina no Umuarama, a Associação anteriormente, quando designada “Condomínio de fato”, executou anualmente múltiplas melhorias de inegável interesse para todos proprietários no Umuarama.        Dentre algumas cumpre mencionar:

1978 – Conclusão da edificação da Portaria mediante a contribuição dos proprietários, na época “arrendatários”;

1979 – Contratação de funcionários registrados em nome do Sr. Hering (serviços gerais) para a Portaria e manutenção de ruas e suprimento de água;

1985 - a Associação Umuarama de Campos do Jordão na época integrada por 6 entidades evangélicas, anteriormente à sua dissolução, partilhou a propriedade do Umuarama entre duas associadas: Associação da Igreja Metodista e o então Instituto Mackenzie (50% cada);

1987 – O escritório interpelou o INCRA (antigo MIRAD), solicitando individualmente Autorizações para o desmembramento de cada área objeto de contrato de arrendamento; (Lembramos que o modulo mínimo de parcelamento na zona rural na época era 20.000 m2);

1988 – Os arrendatários começaram a receber as competentes Autorizações de desmembramento expedidos pelo MIRAD, para lavraturas das Escrituras definitivas;

1989-a - a pedido da Diretoria Jurídica do Instituto Mackenzie (Dr. Osório F. Vieira), o escritório coordenou a triagem - habilitação individual de cada “arrendatário”, baseada nos Contratos de arrendamento em vigor, para que, desde que cumpridas as condições constantes dos contratos de arrendamento, recebessem suas Escrituras de Transferência de Propriedade. Tal analise individual exigiu trabalho criterioso e ampla troca de correspondência entre o escritório, arrendatários,  o Instituto e Ass. da Igreja Metodista.

1989-b – Instalou-se uma linha adicional de água (de PVC-4”) entre a captação Metodista e o Reservatório geral Mackenzie. Esta, foi uma iniciativa do Arrendatário Andrew MacDonald, que cuidou inclusive da restauração das instalações da captação de água. O escritório cuidou do custeio da obra, e do rateio correspondente entre os arrendatários;

1990 - foi concluído dentro da área do I. Mackenzie o levantamento topográfico individual de cada área que se habilitou a receber a Escritura definitiva. O escritório também coordenou as cobranças aos arrendatários e pagamentos à empresa de topografia (Cimontre).
    A partir de 1990 – foram lavradas uma a uma individualmente, as Escrituras de Transferência de propriedade aos então arrendatários, firmadas tanto pelo Instituto Mackenzie como pela Associação da Igreja Metodista junto ao 2º Tabelionato de Notas;
 
Fev/1999 – ocorreu a erosão da barragem do lago superior. Isto teria como consequência o completo assoreamento do lago do Umuarama. Sr.Hering imediatamente mandou vir quatro funcionarios da fazenda Castanheiras (experientes neste tipo de obras) para edificarem uma nova caixa de decantação na barragem do lago danificado. Trabalharam ali durante 5 dias, salvando o lago, que poderia vir a se tornar um brejo.

1999 – Executou-se a instalação do Alambrado ao longo da divisa entre a área Mackenzie e o Condomínio “Céu Azul” (contratação e supervisão do Sr. Hering). Tal obra preservou o Umuarama da suposição por parte de terceirosde considerarem o Umuarama um Parque Público; Tal assunto na época foi tratado diretamente com a Presidência do Instituto (Dr.Cyro Aguiar);

2000 – Os funcionários do condomínio executaram o plantio da sebe de cipreste ao longo de toda a divisa Mackenzie e “Céu Azul”. Tal cerca viva vem sendo podada anualmente, a fim de promover o seu adensamento e não provocar sombra sobre as residências do “Céu Azul”;

2003-a)- executou-se a instalação de mais uma linha de suprimento de água adicional (de PVC-4”) e desativou-se a tubulação de ferro deteriorada, instalada na década 1950 (Após 1/2 século);
2003-b) Instalou-se uma Cancela na portaria, em substituiçao à corrente, utilizada na época;

2004 - Enviou-se circular a todos os proprietários, alertando-os da obrigação legal de regularizarem suas edificações junto à Prefeitura Municipal (aprovação de plantas), segundo Decreto Lei 2241/90, de 08/02/1990, quando a região se tornou zona urbana;

2005 - Iniciou-se criterioso estudo para a elaboração dos Estatutos da Associação dos Proprietários no Umuarama. Após cuidadosa analise, pelos assessores jurídicos da Organização Castanheiras, após 2 anos Sr. Hering submeteu o projeto à Diretoria Jurídica do Instituto - Dr. Roberto Tambelini e representantes da Ass. da Igreja Metodista para aprovação;

2007–a) Foi publicado pelo Tribunal o Acórdão – Processo 000.615.6/9-00, segundo o qual se tornou exigível a localização e especialização relativa a cada Matricula aberta no Umuarama para as áreas ali encravadas, ou seja, instituição de servidão de passagem às propriedades, por parte do Instituto P. Mackenzie e da Ass. da Igreja Metodista;

2007–b) Constituiu-se formalmente a Associação dos Proprietários no Umuarama. Anualmente a partir daquela data o escritório convocou anualmente as Assembleias Gerais Ordinárias, na forma da Lei e dos Estatutos;

2007–c) Rescindiram-se os contratos de trabalho dos funcionários do “Condomínio de fato”, na época registrados em nome do Sr. Hering, e registraram-se-os em nome da Associação recem-constituída;

2008– Executou-se Levantamento topográfico de todos os acessos e a revisão das áreas individuais das propriedades com Matriculas abertas junto ao Registro de Imóveis, para a lavratura das Escrituras de instituição de passagem a serem firmadas pelo Instituto P. Mackenzie e Associação I. Metodista;

2009 – Lavraram-se as Escrituras de Constituição de Servidão de Passagem, firmadas tanto pelo I. P. Mackenzie (14-4-2009), como pela Ass. I. Metodista (18-11-2009)

2010-a) Pavimentou-se o trecho da rua interna - Portaria até a encruzilhada do “U”;


2010-b) Instalaram-se Hidrômetros na maioria das propriedades, a fim de se detectarem eventuais vazamentos, como também para apuração do consumo global no Umuarama.              Mensalmente registram-se em planilha própria o consumo individual efetivo de água, apurando-se por estimativa o consumo global do Umuarama;

2011- Pavimentou-se a subida (de difícil conservação) ao longo da propriedade do Instituto - casa Oripaba;

2012-a) Pavimentou-se o trecho critico ( 220 m.), situado entre a ponte e a portaria.


2012-b) Instalou-se INTERNET na portaria. Adquiriu-se computador, para informatização dos registros de dados (passagens pela portaria, relatórios semanais de tarefas executadas dia a dia pelos funcionários), SKYPE, DROPBOX, para maior facilidade de comunicação e envio de fotos de obras executadas, etc.;

2013 - Pavimentou-se o trecho critico de 55 m. da Estrada Umuarama-Toriba;

Subsequentemente a cada obra de pavimentação, funcionários da Associação executaram os ajardinamentos correspondentes.

2014-a) Executou-se o Levantamento Topográfico e demarcação da divisa Metodista (trechos ainda não cercados) inclusive registro das altitudes de cada ponto;

2014-b) Em Fevereiro/Março sobreveio o triste episodio do corte desnecessário de arvores, que alvoroçou todos os proprietários, por se tratar do primeiro incidente realmente preocupante no Umuarama, relacionado ao meio ambiente, que forçou a Associação a apelar para a Presidência do Instituto, através de Abaixo assinado firmado por 81 % dos associados;

2014-c) Em Maio executou-se a instalação de lombadas, consideradas necessárias (devido ao risco de acidentes) decorrente do desrespeito ao limite de velocidade de 20 Km/h. constatado ultimamente no Umuarama.
2014-d) Em Junho realizou-se a Assembleia Geral Ordinaria da Associação, em que foi ratificado em todos os seus termos o Abaixo Assinado dos Associados, enviado ao Presidente do Instituto P. Mackenzie;

    Cumpre enfatizar que todas iniciativas realizadas, foram sempre precedidas de uma 'Exposição de motivos', providas de projetos, custos etc., submetidos previamente ao Conselho Fiscal e quando necessario, à aprovação da Assembleia Geral dos Associados.
 Obras uma vez executadas sempre seguidas de rigorosa prestação de contas.

    Espera-se, da parte do Instituto P. Mackenzie, que se disponha a reativar o dialogo harmonioso, que sempre existiu no passado, entre a Associação e o Instituto.

To all property-owners in Umuarama:

We wish to clarify that the purpose of the correspondence, written by the undersigned, on April.25.2014 addressed to the President of Mackenzie Presbyterian Institute,

was an attempt to re-establish the harmonious dialogue between the Association's Board, and the Directors of the Institute.

The disaster which occurred in February / March - 2014 - the unnecessary cutting down of trees, at the sole discretion of an employee of the Institute in Umuarama, was truly shocking to all property owners there.

Clearly anyone ecologically aware and sensitive to the environment will realize that irreparable and devastating damage has occurred.

We are seriously concerned about the future of Umuarama and clearly so are the Presidents, Directors as well as staff members in charge, bearing in mind the size and importance of Mackenzie. However these people do retire from time to time, and perhaps their successors rarely have all the information and detailed information of the issues, related to Umuarama, which is 180 km from the directors' desks.

Few are fully aware of Umuarama's history,and so for all interested parties we give below a short version, bearing in mind that during 40 years the care for Umuarama was provided by Mr.Hering's office. It was in Feb / 2014, for the very first time that members were worried regarding this actually serious problem of common interest effecting the Umuarama's property owners.

Our appeal was directed to the Presidency and Board of Mackenzie P. Institute, with the sense of cooperation, and in an attempt to reinstate the harmonious comunication between the Institute and the Owners' Association during so many years.

During the last four decades, the Association contributed significantly to improvements in the Umuarama area, all aimed at its preservation, being a traditional and highly privileged area in Campos do Jordão.

Records as per Mr. Hering's files at his São Paulo office:

The Umuarama Association of Campos do Jordão was established in 1920 through the initiative of Erasmo Braga, who, gathered six evangelical entities, and acquired an area situated in Campos do Jordão (240 Hectares) with the objective of conducting retreats, and enjoying the relaxing atmosphere in the mountains. They hired the well-known contractor, Floriano Rodrigues Pinheiro to build what was called that time "Umuarama Pension", and later renamed the Umuarama Hotel. Around 1940 they hired as  manager, a Swiss hotelier, Daniel Perret who established himself there with his family. Mr. Perret was very appreciated by the staff, guests and, at that time by the Umuarama "lessees"(present owners - Associates). He left the hotel in 1965, but resided in Umuarama until 1985.

 Those times provided an outstanding experience for all adolescents who visited Umuarama, many spent their school holidays there, particularly the students of Mackenzie College. 
Frequent excursions were held to the "Pico do Itapeva", the "Pedra do Bau", “Itamuarama", etc. In fact unforgettable adventures for that generation. The church’s leaders organized retreats, and even preached by the Umuarama lake. At the time, boats ("catraias") and horses were rented out by the Hotel to guests.

The Association (of the Evangelic Churches), intending to provide some revenue for Umuarama's maintenance, rented out lots, for persons interested in building homes in the area. A plan was duly drawn up with lots of different sizes, located mainly at the Northern side of the Estate. These lots were based on a "lifetime-lease", with an annual financial contribution. This helped to maintain Umuarama’s internal roads, and the water supply, which during those years was captured from an old source, located near the present property "Vila Caajara". 

During the 1960s, water became scarce, due to the old and rather narrow gauge waterpipes, which was originally intended to supply only the Hotel, not the whole Estate, then with only a few houses.   Therefore, two tenants: Siegmund Gansl ("Clair Soleil") and Marc de Cepibus ("Sans Souci"), together installed a new and longer supply-line, providing water from a higher spring, filling the general Mackenzie Reservoir, which is still in use today.

In 1965, the Association's board proposed an idea of producing commercially jam from the of the Hotel's orchard.

Hotel manager Mr.Daniel Perret at that time considered this was not possible, and decided to retire. The new manager was, Mr. Paulo Sampaio, a former employee of Superbom (Owned by Adventists).

So the Hotel Umuarama started producing commercially bottled jam, but after few years they realized that this business was not commercially viable, and so leased the area to the "Acampamento dos Pumas", who later vacated it.

In 1975 the buildings and hotel owned by the "AssociaçãoUmuarama de Campos do Jordão" were left completely abandoned and only reopened many years later. At that time the old entrance gate to the Estate was removed.

In 1976 Umuarama was about to fall into the public domain. There was no sign at all informing the public that this was a "Private Property", and many houses were broken into.  This situation and invasion caused much grief to tenants. For example one day Mr. Hering walking with his daughter along the road past the former Hotel, found a parked car where inside a couple were behaving indecently. Mr. Hering warned them that they were in a private area, requesting them to leave. So they did.

The next day Mr. Hering called Dr. Lindolfo K. Anders, (then President of the “AssociaçãoUmuarama de Campos do Jordao”), asking him whether he would support the idea of Mr.Hering joining all the tenants , in order to provide the financing for building a covered gate at the entrance to the Estate, so as to prevent Umuarama falling into the general public domain. Fortunately Dr. Lindolfo, wise man, did not hesitate at all.
He replied right away: "If you, Mr. Hering, gather the tenants, I'll gather the Churches";
Mr.Hering hired an architect who drafted the presently existing modest building at the gate. Dr. Lindolfo sent an alternative larger project, but this would not fit into the space available at the chosen location.
By mutual agreement, the project of Architect Ricardo Oscar Conrad was chosen, the cost of which was about a quarter of the cost quoted for the larger one suggested by the Association.

Mr. Hering's office asked Floriano Rodrigues Pinheiro, for an estimate which was then sent to each owner together with a written explanation of the reasons for the undertaking, informing them the amount each would be required, to pay as a way preserving Umuarama and their homes.
To his surprise after a month his office informed him that the account opened for this purpose, already had enough a balance to fund the construction. Mr. Jayme Rocha Pinheiro, Floriano Rodrigues Pinheiro's son, was hired and who constructed the building.

Returning from an overseas trip, Mr. Hering found the small building finished to his full satisfaction and realized that the contributions had exceeded his optimistic expectations. He therefore hired staff - daytime employees, as well as others for the overall maintenance of roads and water supply. They were registered according the Law, but in Mr. Hering’s name, since the present Association of Owners had not yet been established, which in fact only happened in 2007 - 30 years later.

Prior to hiring a night guard, a chain was padlocked by the gate during the night. Every owner was provided with keys, for use at night. However after some time, an owner who had “forgotten” to carry his key broke the padlock. Thereafter the frequent replacement of the padlock forced Mr. Hering to hire a night-guard.
Out of the 30 owners at that time ("tenants in fact"), only one of them questioned the additional expense, using the excuse that he already had a private caretaker to watch his house. But, at a meeting with Mackenzie, the claiming owner, and Mr. Hering's staff, at the Mackenzie University, with clarification and analyzing the accounts, the person in question did not hesitate anymore and paid his contribution right away.

At that time Mr. Hering was personally responsible for the legal labor contributions, since though having created a so called "condominium in fact", there was no other alternative but to keep the Umuarama staff registered in his personal name, and therefore depositing all the required social contributions.

During this time by Mr. Hering's office assumed the responsibility of managing the so-called Association (“Condominium in fact”)

The “Association” at the time it was designated "Condominium in fact," looked after the routine maintenance in Umuarama, as well as performing throughout the years, multiple improvements of undeniable interest to all “tenants”.

In:

1978 – Construction of the gate ordinance through contributions from all the owners
(at that time "tenants"). Churches, Mackenzie etc.

1979 - Hiring registered staff for the general maintenance of the inside roads, water supply, cleaning the trails, etc.;

1985 - The Umuarama Association of Campos do Jordao, at that time formed by the six evangelical entities, (prior to its dissolution), divided the ownership of the whole Estate into two separate properties: Association of the Methodist Church (South-East part) and Mackenzie Institute (North-West part) 50% each;

1987 - Mr.Hering's office requested from "INCRA" (former MIRAD) the individual permits, for Mackenzie Institute and the Methodist Church, to transfer the ownership of the land occupied by each tenant, (At that time, the size of rural areas were at least 2 Hectare, according to the law, was limited to the minimum of 20.000 square meters each).

1988 - The tenants received the authorization permitting them to request official transfers from “tenants” to definitive ownership.

1989-a - The Legal Department of the Mackenzie Institute (Dr. Osorio F. Vieira), requested Mr. Hering to supply their office, for screening purposes, the individual "tenant's" records, based on the Leases in force, to ensure that they had fulfilled all the leases' conditions, prior to sending the documentation to Mackenzie and then to the Notary in charge of the transfers. This individual analysis required careful and extensive work for Mr.Hering and his team. There was a considerable exchange of mail between the office and tenants as well as between Mackenzie Institute and Ass. Methodist Church.

1989-b - An additional water supply-line (4" PVC pipe) was installed between the spring, within the Methodist area, and the General Mackenzie Reservoir. This was an initiative of the tenant Andrew Macdonald, who took care of the building of a new water collection system at the spring source, thereby ensuing an abundance of water supply. The office handled the collection from all “tenants” for this additional improvement with contribution for the materials and labor;

1990 - A complete land-survey within the I. Mackenzie area was made, surveying each area, to enabled everybody receive their definitive title deed. The office coordinated the collections from tenants and payments made to the survey
 company (Cimontre).
During that year, the Official Transfers of ownership to tenants, were drawn up one by one, and signed by the Mackenzie Institute or by the “Associação da IgrejaMetodista”, according to each location.

Feb / 1999 - The dam of the Superior Lake was suffering from erosion which could result in the complete siltation of the lake Umuarama. Mr.Hering sent four of his staff (experienced in this type of work at the Castanheiras farm), with the job of restoring the eroding dam. During four days they built a new concrete box to allow the water to exit through the pipes under the dam, thereby saving the lake, which otherwise could have eventually turned into a swamp.

1999 - A wire fence was built along the border between the Mackenzie property and the neighboring "Condominio Ceu Azul" then under construction. (Mr. Hering hired a contractor for that purpose). Such fence protects Umuarama against trespassing by the new habitants of that condominium. Otherwise Umuarama could have been considered a Public Park. At this time these matters were handled directly by the President of the Mackenzie Institute (Dr.Cyro Aguiar) and Mr.Hering;

2000 - The Umuarama staff planted a cypress hedge along the Mackenzie borders with "Condominio Ceu Azul". This hedge has been pruned anually, since then, in oder to provide density and prevent any extreme growth causing too much shade over the neighboring houses;

2003-a) - An additional water supply line (4" PVC pipe) was built. Thus, the 1950 deteriorated iron pipes, were disabled; 

2003-b) A new gate bar was installed by the entrance building, replacing the old steel chain;

2004 - A Circular was sent to all owners, drawing to their attention the legal obligation of providing the City Hall with the plans of their constructions, according to Decree Nr. 2241/90 of 08/02/1990, as the region had been declared by the city as urban area;

2005 - Mr. Hering prepared a draft of the Articles for the Umuarama Owners Association to be submitted for approval of the owners. After a careful review, by Mr.Hering's legal counselors, two years later, the draft was submitted to the Legal Department of Mackenzie Institute - Dr. Roberto Tambelini as well to the Legal Department of the Methodist Church, for approval;

2007-a) A Court Sentence (Process 000.615.6 / 9-00), decreed that all Umuarama owners were obliged according the law, to have their occupied area detailed location and access registered. Thus the owners of the two large Estates - Institute P. Mackenzie and Association Methodist Church, formally had to establish, the right of access for each individual property-owner through their estates; 

2007-b)  The Umuarama Owners Association was constituted formally. Annually from that date on, the office has convened the Annual General Meetings, in accordance with Law and the Statutes;

2007-c) Mr. Hering then terminated the employment contracts of all employees of the "Condominium in fact". Their payment was settled according to the law, and then readmitted by the new established Association;

2008- A complete topographic survey was under-taken, as regards the access roads to each property, in order to draft the legal perpetual right of using the roads, through the Mackenzie area as well through the Methodist area. At the same time a detailed review of the individual areas was proceeded, making corrections to register at the Registry of deeds. 

2009 - The proposed Statutes of the Association to be Incorporated were submitted and carefully examined by I.P. Mackenzie's Legal Department 
(04/14/2009), as well by the Methodist Ass I. (18-11-2009).

2010-a) Mr. Hering, proposed, and obtained approval, by the Association's members, to pave a stretch of internal road - from the gate house to the first crossroads by the "U"(can be seen below).;

2010-b) Water meters were installed in most properties, in order to detect any leaks, also allowing the Association to plot an assessment of the overall water consumption in Umuarama. Monthly a spreadsheet is updated, keeping records of individual water consumption, and the calculation of the global water consumption in Umuarama;

2011- In order to prevent future waste of labor and materials, Mr.Hering submitted to the Association's Annual meeting a project for paving the stretch by the "Oripaba" property by the Umuarama lake. Once approved, it was properly paved (as can be seen below);

2012-a) Again, in order to save future labor and materials' on the difficult maintenance on the steep stretch (220 m.), of the access road located between the bridge and the gate house, Mr. Hering submitted to the Associates Annual meeting the project of for this further improvement, which was approved by "tight vote", and executed that year (can be seen below).

2012-b) INTERNET connection was set up at the gatehouse. A computer now registers data in respect of the staff and their information, as well as the individual entries and exits of persons, weekly reports of daily tasks performed by employees, using SKYPE, DROPBOX,etc. as well as for communication so as to provide photos of specific tasks undertaken;

2013 - Mr.Hering contacted neighbors of the Umuarama Estate, as regards paving a critical stretch of the public road 
(55 meters), which leads to Hotel Toriba when coming from Umuarama. After obtaining the approval of the Association's Board, with some additional contributions from 3 neighbors, and the 'cash surplus' from the 2012 project, this project was completed (as can be seen below);

2014-a) Mr.Hering had a Topographical Survey executed along the  Methodist external borders, including recording the altitudes of each marked point;

2014-b) In February / March, 2014 the sad episode of unnecessary cutting of trees occurred in the Mackenzie area. All owners were extremely upset by this devastation. It was the very first truly disturbing incident in Umuarama related to the environment. It forced the Association to appeal to the President of the Institute P. Mackenzie through a Petition signed by 81% of associates to stop the process.

2014-c ) Two concrete sleeping policemen were installed at a curve of the internal road leading to the    
hotel. This was considered necessary, due to the disregard by many drivers, of the 20 Km / h. speed limit established there.

2014-e) Removal of trees which were lying in the Umuarama for a decade, was finally proceeded!

All these initiatives were undertaken after of a prior presentation of an 'Explanation of the Motives', together with the projects' costs estimates etc., after previously submitting the same to the Association's Board of Directors and, when necessary, submitted to the owners' approval
 at the Annual Meetings. Each project after executed was followed by rigorous accountability.

Hopefully, the Institute of P. Mackenzie, in the light of our history together, will be willing to return the harmonious contacts, which always existed in the past between the Association and the Institute.
